Ms. Capone is a partner in the firm’s litigation practice, with focused areas of experience in trusts & estates litigation, commercial litigation, and the representation of community associations.
Ms. Capone has a wide range of experience in trusts & estates litigation, including probate contests, contested accounting proceedings, contested administration proceedings, property turnover proceedings, fiduciary removal proceedings, kinship proceedings, and reformation and construction proceedings. She has also been approved and appointed to serve as Guardian ad Litem in Surrogate’s Court and guardianship proceedings, as well as Court Evaluator in guardianship proceedings.
As part of her role as a partner in the firm’s litigation practice group, Ms. Capone has experience over a range of commercial and real estate litigations for corporations and individuals, including breach of contract actions, partnership disputes, commercial and residential landlord-tenant disputes, and unique experience representing parties in disputes arising out of claims to the title and the authenticity of artwork.
Ms. Capone also counsels the boards of cooperative apartment corporations, condominium associations, and homeowner associations in the New York Metropolitan area, and has experience in objectionable conduct proceedings, as well as holdover and non-payment actions. As part of her practice in this area, Ms. Capone has also represented developers and sponsors of community associations in the creation and offering for sale of ownership interests in such projects.
